Terms of Service
Effective date: April 12, 2026. These Terms apply to the Availy mobile application and related services (“Service”) offered by Availy (operated by Jonathan Strickland) (“we,” “us,” or “our”).
1. Agreement
By accessing or using the Service, you agree to these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
2. The Service
Availy provides tools to help teams manage scheduling, availability, time-away requests, communications, and related workforce coordination. We may modify, suspend, or discontinue features with reasonable notice when practicable.
3. Accounts & eligibility
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. You must be at least the age required in your region to enter a binding contract (often 18+). We may refuse or close accounts that violate these Terms.
4. Subscriptions & fees
Some features require a paid subscription. Pricing is subject to change with reasonable advance notice. Current published pricing (USD) includes:
- Monthly: $25/month per organization, includes 20 active users; additional active users are $1 each per month.
- Annual: $240/year per organization (about $20/month effective), includes 20 active users; additional active users are $9.6 each per year (about $0.8/user/month effective).
Depending on how you subscribe, payment may be processed by Apple (App Store), Google (Google Play), or Stripe. Taxes may apply. Subscriptions may auto-renew until canceled in accordance with the platform’s rules. Refunds, if any, are governed by the applicable app store or payment provider policies.
5. Acceptable use
You agree not to:
- Violate law or others’ rights
- Attempt to probe, scan, or breach our systems
- Reverse engineer except where prohibited by law
- Upload malware or misuse the Service to harass or harm others
- Circumvent billing, access controls, or usage limits
6. User content
You retain rights to content you submit (e.g. schedules, messages). You grant us a limited license to host, process, and display that content solely to provide and improve the Service. You are responsible for the content you submit and for having any necessary rights to share it.
7. Intellectual property
The Service, branding, and software are owned by us and our licensors. Feedback you provide may be used without obligation to you.
8. Third-party services
The Service may integrate with third parties (e.g. authentication, analytics, subscription management, payment processing). Their terms and privacy practices also apply where you use those services.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnity
You will defend and indemnify us against claims arising from your use of the Service, your content, or your violation of these Terms, to the extent permitted by law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or risk to the Service or others. Provisions that by their nature should survive will survive termination.
13. Changes
We may update these Terms. We will post the updated Terms and update the effective date. If changes are material, we will provide reasonable notice as required by law or platform rules. Continued use after the effective date constitutes acceptance of the updated Terms.
14. Governing law & disputes
These Terms are governed by the laws of the United States and the state or jurisdiction where Jonathan Strickland resides, excluding conflict-of-law rules. Courts in that jurisdiction have exclusive venue, unless applicable law requires otherwise.
